The application of filing of Trade Mark is submitted with the Registrar. A Trade Mark registration fee needs to be submitted with the application. The fee for filing of application to register a trade mark for specification of goods or services included in one class is Rs. 4000/-.
The application can be filed at any one of the five Trade Mark Registry offices (Trade Marks Registry, Mumbai, Delhi, Kolkata, Ahmedabad, Chennai), whichever has jurisdiction over the state. The application can also be filed online.
The trade mark registration application must have the following information:
- The Trade Mark
- Name and address of trade mark owner
- Trade mark class
- Date since the trade mark is being used
- Description of goods and services
Once the trademark filing is done, the Registry will issue an official receipt which will contain the filing date and the number allotted to the application. After submission, the application is formally examined by the Indian Trade Marks Office to check whether the trademark in question is similar to existing trademarks or not.
After registration, the trademark is valid up to 10 years from the date when trademark application is filed.
