The Delhi High Court recently decreed a declaration suit in favour of the assignee of Internet and Digital Copyright, declaring him as the owner of copyright vested in the 19 cinematograph films which were the subject matter of the suit at hand. Injunction was also issued against the assignor from interfering with the exploitation of rights by the assignee. Various interesting issues in respect of royalty viz. a viz. consideration, and assignment under undue influence were raised by the defendant while trying to defend the suit at hand, albeit no evidence was led in respect of any of such defensive pleas.
