Opposition Board must be reconstituted when evidence is filed after issuance of Board Recommendations

In a recent judgement dated December 12 2023, Hon’ble Madras High Court in the matter of Optimus Drugs Private Limited Vs. Union of India and Ors., while dealing with a writ of Certiorarified Mandamus, held that when additional evidence was filed by both the parties after the issuance of recommendation of the opposition board, in order to preclude the possibility of confirmation bias, the opposition board should be reconstituted.
