The Delhi High Court Ruling on the Remedy of Letters Patent Appeal Against the Decision of a Single Judge

In the present case of Promoshirt SM SA v. Armassuisse and Anr., the Delhi High Court rejected the preliminary objection of the respondent on the maintainability of the Letter Patent Appeal based on Section 100A of the Code of Civil Procedure, 1908. The appellant Promoshirt SM SA. had filed the Letters Patent Appeals against the judgment dated January 4, 2023, of the Single Judge of the Delhi High Court. The Single Judge, while hearing an appeal against the order dated July 25, 2022, of the Deputy Registrar of Trademarks, had refused to register trademark applications for composite label and wordmark of Promoshirt SM SA. for textile goods.
